Merit of Two Kashmiri Messages

Dr. Syed Nazir Gilani

Year's end is neither an end nor a beginning but a going on, with all the wisdom that experience can instill in us. Our leaders did not consider it worthwhile to give a message embedding an agenda of hope to the people of the State living on either side of cease fire line (LOC) and abroad.
On the contrary two leaders Hurriyat (M) chief Mirwaiz Umar Farooq and JKLF chief Muhammad Yasin Malik decided to address the Governments of India and United States of America on two different issues. It is important to examine the merits of these two political statements. Hurriyat leadership has complained that there is a confusion in the Indian establishment on dialogue and has quoted the role of Army which is overbearing on the question of the removal of AFSPA in Kashmir. If Indian army is an impediment in any dialogue, our leaders should examine the role of Indian security forces under the agreement between the Government of J & K and the Government of India. It could examine UN SC stipulations on the presence, number, behaviour and location of these forces.
Dialogue is the civilized instrument developed over the centuries to settle disputes among various communities and various countries. India and Pakistan continue to talk and conduct intra-State business. They carry out other duties obliged under UN Charter as member nations of UN. Pakistan has taken upon an additional responsibility to give moral, political and diplomatic support. Kashmiri leadership would remain accountable for the manner in which they have used this support in the best interests of their people. Elements at various levels in the Government of Pakistan who have controlled this hype of moral, political and diplomatic support have an associate responsibility to account for any success or loss.
The net result is that we have made very little or no progress. On the contrary Kashmiri struggle has lost nerve and before the end of the year it has been incriminated in USA, which is a serious setback. Our leaders in Kashmir have no clue that they have killed the right of self-determination for some time to come. The numerical death of a generation would translate as a deficit into any future determination. Our leaders have to be very honest and understanding to accept that at this point they have been unintentionally or intentionally doing the Indian or Pakistani bidding in a dialogue and have failed to discipline themselves to represent the case of the people of Kashmir.
The first and foremost should have been to be clear headed on issues that need to be taken with India and Pakistan individually and other issues that need to be discussed trilaterally. A trilateral discussion is misdirection of wisdom because it does not address the question of J & K, AJK, Gilgit and Baltistan, 2.5 million Kashmiri refugees and the Kashmiri Diaspora. Demand for a trilateral discussion right in the beginning is to derail the process of a discussion. Kashmiri leadership has to conduct bilateral dialogue with India and Pakistan and prepare to move into a trilateral stage.
Mirwaiz Umar Farooq has stated "We are not against dialogue and are ready for meaningful tripartite talks. But talks shouldn't be held for the sake of talks. It should be result oriented process. Dialogue process till now failed because India was never serious in talks. We had given some proposals to New Delhi last time but no forward movement was made," He needs all support and guidance on his desire to advance the process of dialogue. Unfortunately the Kashmiri political wisdom does not add up to a valid desire. A common man would be asking many questions around any discussion with India and Pakistan. The first would be the responsibility of the death of a generation and the second the unprecedented suffering never witnessed from 1846 until 1990.
The desire for a tripartite dialogue does not have a merit. We may be accused of playing to a non-Kashmiri dulcimer by making this demand. India has a case at the UN and it has to be challenged in accordance with the pledge that it has made in its presentation at the UN Security Council. Pakistan has assumed responsibilities in AJK under UNCIP resolution and in fact has not conducted itself in accordance with the obligations under UNCIP resolutions. The claim that Hurriyat has given any 'proposals' to Government of India does not carry any weight because there has never been any debate on the basics of these proposals. Mirwaiz Umar Farooq and his senior associates have to admit that not all or no constituent in the alliance has any reliable understanding of the Kashmir case and could not be assuredly trusted to enter into a dialogue with the Government of India at any level.
JKLF chief Muhammad Yasin Malik addressing a seminar "Diplomatic Front of Kashmir Struggle and Dr Ghulam Nabi Fai" has said that US will lose its "constituency" in Kashmir and create "anti-America sentiment" in the valley if it continues to detain the Kashmir American Council (KAC) director. He has asked US Government to go lenient on Fai. The effort of JKLF prima facie is commendable but it has its own problems. Fai is a State Subject and on this account there could be no two opinions that his situation needs to be considered not only by JKLF but by all other political parties, Kashmiri Governments and every citizen of Kashmir.
To begin with such seminars and the names that have featured at this seminar (mostly known regulars) would not make any impact on the Government or the judicial system of USA. Fai of course is a decent human being but it does not mean that as one of the three Directors of Kashmir Centres he has conducted himself to a major extent independently in the best interests of the jurisprudence of Kashmir case. The affidavit filed in his case has accused him of carrying an 80% non-Kashmiri brief. Acting as an escort for any Valley or other leader in USA has been part of his employment and it does not make him a 'peace maker'. It is not helpful to note that according to court documents, the KAC was secretly funded by officials employed by the government of Pakistan, including the Inter-Services Intelligence Directorate (ISI). At the same time Kashmiri leaders who Fai had been instructed to escort and facilitate in USA or elsewhere have equally offered their heads to the fall of 'American Hammer' in the future.
There is good news that US Government in exchange of a 'bargain' with Fai has dropped the serious charge 'Conspiracy to act as an unlawful agent of a foreign government. He has now been charged on two counts, namely, (1) falsify, conceal and cover up material facts and (2) defraud the Treasury Department. He has pleaded guilty to conspiracy and tax violations in connection with a decades-long scheme to conceal the transfer of at least $3.5 million from the government of Pakistan to fund his lobbying efforts in America related to Kashmir.
As part of his plea agreement, Fai has agreed to forfeit his interest in $142,851.32 seized by the government in July 2011. After the please bargain Fai faces a maximum potential sentence of five years in prison for the conspiracy count and a maximum three years in prison for the tax violation. Judge O'Grady has set sentencing for March 9, 2012.
On 7 December 2011 Fai admitted that, from 1990 until about July 18, 2011, he conspired with others to obtain money from officials employed by the government of Pakistan, including the ISI, for the operation of the KAC in the United States, and that he did so outside the knowledge of the U.S. government and without attracting the attention of law enforcement and regulatory authorities.
There is no denying the fact that Kashmiris need finances to advance their Rights Movement. These funds could have been obtained from the Government of Pakistan as part of its duty under UNCIP resolution and from any other member nation of the UN (including India). The litmus test for this financial support should have been all inclusive and the best interests of the people of Kashmir.

As reported, President Barack Obama signed a sweeping US defense funding bill on Saturday, which includes new sanctions on financial institutions dealing with Iran's central bank, and curtailing up to $850 million in aid to Pakistan.

Now, (after President Barack Obama approved sanctions over Pakistan, effective 1st Jan. 2012), it is very appropriate time that Pakistan closes it's air space for US and NATO planes, on the premise that sanctions are not imposed on friends.

It's an extremely unfriendly act and sanctions means they consider Pakistan as enemy. So, we must also act in our own interest, in a firm and bold manner. Stand up Pakistan, its now or never.

If the US has no consideration of our enormous sacrifices of men and material, we should also not go with them any further mile in their imposed war on terror. Why should Pakistan suffer eternally, for the intelligence failure of American agencies in preventing 9/11 attacks on America, in which no Pakistani was ever found to have been involved. Moreover, if Osama Bin Laden was involved in 9/11 attacks, he too was a made in America product. All said and done, Pakistan is being punished continously for the crime of siding with America, in their imposed war on terror, for which no country on earth has suffered more than Pakistan.

For Pakistan, enough is enough. America can't have cake and eat it too.

US economy gaining steam

Air Marshal Ayaz A Khan (R)

US economists and the media, including New York Times. Los-Angeles Times, Wall Street Journal, Herald Tribune have acknowledged US economic growth in 2011. The Standard and Poor's 500 index is outpacing the stock bench marks in Frankfurt, Sao Paulo, Tokyo, Shanghai, and Hong Kong by 15 percentage points or more this year." The Dow industrials rose 135.63 points on improvements in the housing and employment sectors. Fewer Americans are filing new jobless claims than at any time, The consumer index is improving, an indicator for end to recession. This is the latest positive signal for the US economy.

The US economy had started slowing down in 2007. The mortgage crisis began to weigh down on Wall Street in late 2007. US stocks nose dived in 2008, with pessimists forecasting 1930's recession. Massive job losses, the automobile industry collapse and bankruptcy, the mortgage scandals, bank closures, hundred's of thousands becoming jobless, provided evidence of implosion from within. America could become another Soviet Union. In 2008 on Wall Street US stocks fell more steeply than else where. It was argued that in Asia, China, Japan, India, South Korea and economy of Asean countries had "decoupled" and will grow despite slow down of the world's largest economy. By 2008 the woes of the US financial system had spread around the world, dragging down global stocks and casting doubts on the decoupling thesis. Now the Euro has hit a 15-month low against the US Dollar, as Europe's sovereign-debt problems continued to wear away investors confidence. After Greek and Portugal the Italian economy is in a mess. The cost of funding Italy's long term debt remained high, shying away rich European countries especially Germany and France to help Italian governments efforts to fend off public rallies against governments austerity measures. Even Italy's flourishing auto industry is in trouble.

Four years later the decoupling is moving the US economy in the right direction. "Investors bet on the ability of the US economy to power through Europe's sovereign debt crisis." And concerns in Asia about inflation and sharp slowdown in growth is helping the US economy. The Japanese auto industry, world leader till recently is under pressure because of the over priced Japanese Yen." Honda has decided to shift four Honda manufacturing units out of Japan to the US and Mexico. In the US Honda sales are now behind the Korean Hyundai automobiles.

For much of the 2011, the US stock market served as a safe heaven, largely because of the propensity of US investors to bring back funds from overseas during times of uncertainty. Federal Reserves accommodating policies and resolve of the Federal government to bail out the automobile industry, has brought the US economy back on rails.

In 2009 the automobile industry was near collapse. The big three- General Motors, Ford and Chrysler were in the red. To save GM and Chrysler form insolvency these were allowed to borrow 30 billion and 20 billion dollars respectively, but the state became the bigger share holders. Within two years both the auto giants have reshaped themselves, and in 2011 they returned the massive loans with interest. Ford did not borrow, but overhauled it self. Today the US auto industry is producing better designed and fuel efficient vehicles, and is edging Toyota and Honda, and making big profits.

The redesigned US compacts are better, solidly built and have lower fuel consumption and reliability. The Japanese automobiles were in serious trouble with the recall of 20 million Toyota's Corolla, Camry, Highlander and the latest Preius hybrid cars for modifications to fuel systems and accelerators. Honda also recalled half million compacts and SUV's.

The US economy is ending the year of financial uncertainty on a positive note. The unemployment figures recorded by the US Department of Labour and economists indicate the lowest levels of unemployment since June 2008, when he US economy was mired in recession. The unemployment data, along with positive figures from the housing and manufacturing sectors, suggest that the economic recovery is once again gaining momentum after nearly stalling earlier this year (2011). Economic statistics have consistently shown the growth of the US economy, albeit slowly.

Michael Gapen, an economist with Barclays Capital states, "the economic growth is durable. It may not be robust, but it is expansion. Fewer people are loosing jobs, not that more people are being hired, but this is a positive indicator for the economy. Detailed report on State of the Labor market will be release by mid January 2012.

The manufacturing sector is showing signs of strength. Manufacturing activity in the industrial Midwest rose sharply in November 2011,and remained steady in December. The National Association of Realtors have reported that, pending homes sales rose sharply in November in more than a year, and rose for the third consecutive month. It was up 6% from November 2010. Home construction is picking up and sale of existing and new homes are on the rise. The consumer shopping is the highest since two years. The European debt crisis had no effect on the US economy so far. But continuing economic crisis in Europe, Economic slow down in Japan and signs of economic slow down in China, partisan gridlock in Washington and budget cuts by states and local governments will have adverse impact on the US economy. Positive economic indicators and steady economic growth is good for the Democrats. This will assure Barrack Obama's re-election as President of the United States of America for the second term.

Energy Decisions: Govt reducing country to Stone Age

Dated: Jan 01

Islamabad: Samina Fazil, founder President, Islamabad Women's Chamber of Commerce and Industry (IWCCI) on Sunday said the incumbent government failed to provide any relief to masses in 2011.

Controversial policies and unpopular decisions have made life very difficult for masses and business community, she said.

The present incapable setup is not expected to bring any change in the next year, said Samina Fazil while speaking to the women entrepreneurs.

She said that there is no shortage of gas and electricity in the country. Gas is being silently provided to some influential sectors while electricity sector is victim of mismanagement where thefts have touched 24 per cent of total production.

Samina said that recent CNG decision will hurt millions of families and businesses, bring new wave of price hike and add to the unemployment and uncertainty as well.

In 2011, on average masses braved 8 hours of load shedding, experienced CNG closure in summer, faced closure of thousands of businesses, saw three per cent fall in GDP, dwindling rupee and unprecedented rise of dollar, political uncertainty, scams worth billions and international disgrace, she observed.

Samina said that the critical sector of petroleum and natural resources is being run as a hospital which proves concern of rulers towards grave issues and plight of masses.

Country is reeling under various issues but the rulers lack interest, care or feeling which is ample proof of their tall claims of pro-poor policies.

She said that business community has lost any hope in the rulers.

New Year, more traumatic
PEW paints gloomy picture of 2012
Economic reforms to remain a far cry
No plans to put economy back on track

Islamabad: [Jan 01]
The Pakistan Economy Watch (PEW) on Sunday said the New Year will bring more pains to the dejected masses.

There are slim chances of economic recovery in 2012 as government will continue to divert all energies to the on-going political struggle, it said.

The rulers are just interested in securing themselves and gaining political mileage; they lack will to take concrete policy actions, said Dr. Murtaza Mughal, President of the PEW.

He said that short-sighted decisions and mismanagement proves that economic revival is something that is yet to attract leadership or opposition.

Dr. Murtaza Mughal said that PEW expects 3-4 per cent fall in GDP, lower agricultural growth by 7-8 per cent, inflation beyond manageable limits, futile attempts by SBP to contain rising prices and printing of currency, enhanced current account deficit, and dwindling foreign inflows.

International lenders may not change their attitude which will keep local currency and reserves under pressure while dollar may climb, he added.

He said that Government will continue to keep tax-to-GDP ratio in single digit to please landed nobility and avoid reforms in public sector enterprises to please party workers which will inflict a loss of around Rs 400 billion.

It will be difficult to meet revenue target of Rs1,952 billion as government will continue to compromise due to the elections which can widen the fiscal deficit to 7 per cent, he said adding that domestic debt will touch Rs 1.5 trillion mark by the end of this fiscal.

The textile, automobile, cement, pharma and fertilizer sectors will feel the heat while food insecurity and reduced allocations in the PSDP will be additional factors haunting masses, he said.

The prices of fuel, electricity, vegetables and all edibles will go up while sugar prices may remain averagely stable.

Dr. Murtaza Mughal said that energy crisis; Rs 400 billion circular debt and deteriorating environment will continue to contribute to reduced business activities, compounded uncertainty and missed growth targets in the 2012.

Masses should not expect any improvement in 2012 as it will remain a tough year for majority who will face more jolts.

MS. HINA RABBANI KHAR THE FOREIGN MINISTER OF PAKISTAN MUST INTERVENE TO OBVIATE THE HARSH JUDGMENT REGARDING DR. SYED GHULAM NABI FAI: HABIB YOUSAFZAI, WORLD KASHMIR DIASPORA ALLIANCE

There is no precedence of struggle for freedom in the annals of history available wherein someone has solely relied  to solve an issue through negotiations as Dr. Syed Ghulam Nabi Fai has done for Internationally Disputed Area of Jammu and Kashmir (IDA:JK). After going through his case it is evident that it was an inadvertent mistake as he was unable to maintain his book of account. He has indubitably proved himself as a skilled arbitrator as he has been favored by all three legitimate parties to the (IDA: JK) such as Kashmiris, Pakistan, and India.

For instance, I recall that I had gone through a Pakistani document regarding the subjects of Kashmir, wherein it stipulated that all the resident of IDA: JK are the citizens of Pakistan. In view of this fact, Dr. Fai is the citizen of Pakistan. More often than not, in any case involving citizens from Canada and USA who face some sort of threat abroad, the Government of Canada or USA utilize the authority of their foreign offices in the recipient country to help the individual evade the problem.

Accordingly, Ms. Hina Rabbani Khar the foreign Minister of Pakistan is therefore solicited to kindly intercede in the matter of Dr. Fai to free him from this erroneous accusation. Meanwhile, a Pakistani Passport should be issued to Dr. Syed Ghulam Nabi Fai to pave a way to appoint him as negotiator for the purposes of resolving the IDA: JK by reinstating the UN resolution of 1948 regarding plebiscite.

Separatists, civil society pitch for justice to Fai

SRINAGAR, Dec 31, 2011: Rising openly in support of Dr Ghulam Nabi Fai, the civil society representatives in Kashmir and the separatists today unanimously passed a resolution seeking justice to the US based executive director of the Kashmir-American Centre.

The resolution was passed at the seminar, 'Democratic front of the freedom movement and Dr Ghulam Nabi Fai', organized here by the Jammu and Kashmir Liberation Front (JKLF)with participation from advocates, academicians, doctors, columnists, journalists, political leaders and the members of the civil society.  The seminar was also to pay tributes to the slain Prof Abdul Ahad Wani .

"…the assembly while taking cognizance of, and noting appreciation of his diplomatic efforts, urges Government of United States, the International community and freedom lovers around the world to recognize the role of Dr G N Fai as a moderating influence in seeking a solution to the unique problem of State of Jammu and Kashmir. His unconditional and unreserved efforts as the son of the soil in bringing together all stake holders, persons of different shades of-opinion Governmental and Non-Governmental representatives together on the negotiating table to evolve a peaceful solution through process of dialogue, constitutes an important basis in judging Ghulam Nabi Fai's involvement in the cause of freedom for his people," read the resolution passed in the seminar. "Defective analysis of the consequences," it read, "of the choice he made needs to be avoided to prevent miscarriage of justice….Expressing their full confidence in the judicial system of U S A, the assembly believes and trusts, that justice will not only be done, but seen to be done to Dr Ghulam Nabi Fai in the days to come and on the awaited occasion."

It was the second resolution passed within a fortnight in favour of Dr Fai.
Earlier on December 24, a resolution was passed by the assembly of civil society members, intellectuals, writers and political leaders at the seminar organized by the Hurriyat conference (G). In the resolution, the participants announced their complete support to Dr Fai.

The chairman JKLF, Mohammad Yasin Malik, however, said the prosecution of Dr Fai would lose America the "constituency" in Kashmir, and that leniency in the case was must for resolution of the Kashmir issue.

"By keeping him (Dr Fai) in jail, is not America losing its constituency in Kashmir? Is it not it creating anti-America sentiment in Kashmir?" Malik asked in his address at the seminar.

"..If Kashmir issue is to be resolved peacefully, the US must show leniency in Dr Fai's case," he said.

Malik urged that both India and America should acknowledge the role played by Dr Fai whom he described as the "peace maker."

"I am not trying to point fingers at the judicial system of that country (US)," he said, "Perhaps there are certain unique norms in the US law and that may be why Dr Fai was arrested. But having said that, I want to clear it to both India and the US that he (Dr Fai) is a 'peace maker' who wants a political and peaceful resolution of the Kashmir issue."
The JKLF chairman cited instances where the lobbyist was involved by New Delhi in the peace process.

"I suggested Dr Fai's name to the Indian government for bringing militants to the table. The suggestion was acknowledged by the then Indian prime minister who actually sent one of his cabinet ministers to meet Dr Fai in America," he said and urged the society to rise in support of Dr Fai.

"…It was him who took Kashmir issues into the US parliament and the senate, and discussed it in Universities across that country. He took Kashmir issue to every US think tank. Today when he is in jail we shall think how to help him to get out of this trouble," he urged.

Malik also paid rich tributes to Prof Abdul Ahad Wani on his 18thdeath anniversary.
'Dr Fai was made scapegoat'.

The Hurriyat (M) senior leader and Chairman National Front, Nayeem Ahmad Khan, however, termed Dr Fai's arrest a result of US-ISI tussle. Dr Fai, he said, was made a scapegoat in tussle between the Pakistan intelligence agency and US.

"The main thing is that the Dr Fai was made a scapegoat in the tussle between ISI and the US. It was the situation changed in 2000 that the US started creating problems for Dr Fai. Otherwise the technical issues were there in the past also, but Dr Fai was never arrested," Khan pointed out.

Seconding the JKLF chairman, he said the US would lose its "constituency in Kashmir" and across the world if it continues to persecute Dr Fai.

"We should pass a resolution and send it to USA that Fai was a man of peace," Khan said.

Advocate Zafar Shah praises Dr Fai Those pleading the case of Dr Fai included advocates also.

The noted lawyer, Advocate Zafar Shah, praised Dr Fai for confessing to his charges.
"To me the greatest moment was when he confessed to the charges leveled in him. I see Dr Fai as the son of the soil with the difference because here we have people yet to confess what they do. We are hypocrites, but Dr Fai as well as Prof Abdul Ahad Wani has been person of great integrity," Shah said.

Dr Sheikh Showkat questions justification to prosecute Dr Sheikh Showkat, professor of law the University of Kashmir, questioned the America's justification for prosecuting Dr Fai for she has never abided by the law. "Has the US always followed law? What law did US follow in Guantanamo?" he questioned.

"Dr Fai was a person who did not lose his integrity in US. He went to US and worked for his homeland," Dr Showkat added and urged the society to follow his example.

"We must be true to our conscience and the same must reflect in our actions. If we do not do that we will be disconnected and separated, and we will become fossils. From these two persons (Dr Fai and Prof Wani) we must learn not to beg." 'Society must stand by him'

The high court bar association president, Advocate Mian Abdul Qayoom, said the society must stand by Dr Fai. "We shall be thankful to those who speak in our favor. And, if Dr Fai has done anything we shall support him. We must acknowledge his support to the Kashmir cause irrespective of him being an agent or not." 'Contribution will go waste'.

Dr Sheikh Mohammad Iqbal, who was presiding over the function, said the contributions of Dr Fai, and people like him, would be nullified if the Kashmiri society continues to do what it has been doing.

"The contribution will be reduced to zero if we continue to do what we are doing," he said, citing the example: "We are selling our land and buying cars."

The others who spoke on the occasion included: Zahid Ghulam Muhammad, Dr Javid Iqbal and Riyaz Masroor.

UMER MAQBOOL

Srinagar, Dec 31, 2011: Hailing the contribution of Dr. Ghulam Nabi Fai and Prof. Abdul Ahad Wani in the ongoing struggle, Jammu and Kashmir Liberation Front Chairman Muhammad Yasin Malik Saturday said resistance movement needs a powerful diplomatic front for success.

Addressing a seminar titled "Diplomatic front of the movement and Dr Ghulam Nabi Fai" on the anniversary of the noted legal luminary Prof. Abdul Ahad Wani, Malik said resistance movement cannot achieve success without having a strong diplomatic front for lobbying of the cause.

Asking the United States to take lenient view in the case of Dr. Fai, Malik said, "I don't want to question or confront US judicial system but I would make an appeal to them to take lenient view in Fai's case as he was a peacemaker. It will be their biggest support to the moderate constituency which wants peaceful resolution of Kashmir, without bloodbath and hatred. We need to see Dr Fai on bigger canvass, he was representing peaceful constituency."

Terming Fai as an ambassador of Kashmir, Malik said he always stood for peaceful resolution of Kashmir. "Whenever Kashmiri leaders or intellectuals visited USA, he extended hospitality to them and arranged their meetings with US government officials.  He took Kashmir issue into US Senate, Congress and universities," he said.

Asserting that action against Dr. Fai would create anti-US constituency in Kashmir, Malik said, "Fai is not a person but an institution who always spoke moderate language in United States and other parts of the world."

JKLF chairman also disclosed that he suggested the name of Dr Fai to India for bringing militants on board after initiation of peace process between India and Pakistan in 2004.
"During parleys with PM, I asked for the involvement of militants and PM gave serious thought to my suggestion. I asked PM to approach Dr. Fai to strengthen peace and dialogue," he said, adding that a then Central Cabinet minister also met Dr. Fai over the issue of engaging militant leadership.

Malik said during his meetings with US Assistant Secretary Christiana Roca and advisor of president on south Asia; he pitched for involvement of militant leadership in the peace process.

Praising the contribution of Prof. Abdul Ahad Wani who was killed on December 31, 1993, Malik said international figures were impressed by his intellectual capabilities.
"When United Nations Army General met Wani, he told him if there are 10-15 persons in the world like him there would be a revolution. The US assistant secretary of state Robin Raphel after a meeting with Wani said that she doesn't think US President is more intelligent than him. Shadow Foreign Minister of Labour Party during an interaction with him was taken by his intellect," he said.

Malik said Wani defended the struggle in early 90s and mobilized global opinion in favour of the struggle by his capabilities. "History will never forgive the killers of Wani nor they can be part of civilized society," he said.

Senior separatist leader and National Front Chairman Nayeem Ahmad Khan said Dr. Fai is representing the sentiments and aspirations of Kashmiris. "Entire Kashmir is at his back .America should know that representing the aspirations is not a crime under any law of the world," he said.

Paying tributes to Prof. Wani, Khan said best tribute to the martyrs of Kashmir is to take the ongoing movement to its logical conclusion."Conscious nations don't forget their martyrs," he said.

Senior Hurriyat (M) leader and Ittehad-ul-Muslimeen patron Moulana Abbas Ansari said Kashmiris shouldn't expect any favour from US or other Western powers as their policies are guided by their interests. "We should leave everything to Allah and these powers cannot be of any help to us anyway," Ansari said, adding that leadership shouldn't desist from calling spade a spade. "We should always speak truth," he added.

Former HCBA president Nazir Ahmad Ronga in his speech said that status quo will lead to slavery and "we should accept 1953 position as an interim arrangement." "We are in the search of peace and need way out for the resolution of Kashmir issue. Leadership shouldn't shy away from talking if India is making an offer," he said.

Noted columnist Z. G. Muhammad said Kashmir lacks proper documentation about the heroes who gave their life for motherland. "I have one grouse that none of us tried to document life of our martyrs and their contribution to the struggle," he said, adding that Kashmir is yet to produce any intellectual. "We cannot call a person intellectual who writes for getting award and in real sense the intellectual means who stands by right side," he said.

Senior High Court Lawyer Zaffar Ahmad Shah said both Dr. Fai and Prof. Wani were the men of integrity. "If we look at their personalities they stuck to their integrity despite suffering immensely," he said, adding that "advocate" writers are causing damage to the movement. "If they are getting paid for write-ups, they are misleading the people. They shouldn't write then," he said.

President of High Court Bar Association Main Abdul Qayoom said people need to introspect and choose between right and wrong. "We don't know with whom we are affiliated. During 2008 lakhs of people came on roads but voted in large numbers during assembly elections. Same happened in 2010," he said, adding that masses need to differentiate between benefactors and oppressors. Qayoom added that stable Pakistan was in the interest of Kashmiris and 'its weakness will tell upon our movement.'

Noted journalist Ghulam Nabi Khayal said two decades after the brutal killing of Mirwaiz Moulana Muhammad Farooq, his killers are yet to be arrested.
"After the killing, then director general of police J.N. Saxena told me that they have arrested two persons involved in the killing and third person is absconding. But two decades down the line killers are yet to be identified," he said.

Kashmir University Law department faculty member Dr. Shiekh Showkat Hussain said international community including US cannot be mobilized by petitions. "History stands testimony to the fact that US has always been vulgar culprit and abuser of international norms," he said, adding that its policy is determined by economic interests. "When India opens its markets, Kashmir ceases to be a nuclear flashpoint for US," he said.

Among others, Advocate Sareer Fazili spokesman Kashmir American Council (via telephone), Prof. Shiekh Muhammad Iqbal, Dr. Javaid Iqbal, Abdul Majid Zargar, Dr. Zaffar Mehdi, Prof. Rehman Rahi, Riyaz Masroor, Dr. Altaf Ahmad spoke on the occasion. The speech of JKLF supreme head Amanullah Khan was read by Showkat Ahmad Bakshi while proceedings of the seminar were conducted by Shiekh Abdur Rashid.

On the occasion, a resolution asking US to administer justice in the case of Dr. Fai was passed.

The resolutions says: "An assembly of Kashmiri political formations, jurists, intellectuals, public thinkers, doctors, historians, scholars and civil society was organized by Jammu Kashmir Liberation Front (JKLF) to deliberate upon Dr. Ghulam Nabi Fai's role on the diplomatic front of Kashmiri freedom struggle. The assembly while taking cognizance of, and noting appreciation of his diplomatic efforts, urges Government of United States, the international community and freedom lovers around the world to recognize the role of Dr G.N. Fai as a moderating influence in seeking a solution to the unique problem of State of Jammu and Kashmir; his unconditional and unreserved efforts as the son of the soil in bringing together all stake holders, persons of different shades of-opinion, Governmental and Non-Governmental representatives together on the negotiating table to evolve a peaceful solution through process of dialogue, constitutes an important basis in judging Ghulam Nabi Fai's involvement in the cause of freedom for his people. Defective analysis of the consequences of the choice he made needs to be avoided to prevent miscarriage of justice."
