MS. HINA RABBANI KHAR THE FOREIGN MINISTER OF PAKISTAN MUST INTERVENE TO OBVIATE THE HARSH JUDGMENT REGARDING DR. SYED GHULAM NABI FAI: HABIB YOUSAFZAI, WORLD KASHMIR DIASPORA ALLIANCE
There is no precedence of struggle for freedom in the annals of history available wherein someone has solely relied to solve an issue through negotiations as Dr. Syed Ghulam Nabi Fai has done for Internationally Disputed Area of Jammu and Kashmir (IDA:JK). After going through his case it is evident that it was an inadvertent mistake as he was unable to maintain his book of account. He has indubitably proved himself as a skilled arbitrator as he has been favored by all three legitimate parties to the (IDA: JK) such as Kashmiris, Pakistan, and India.
For instance, I recall that I had gone through a Pakistani document regarding the subjects of Kashmir, wherein it stipulated that all the resident of IDA: JK are the citizens of Pakistan. In view of this fact, Dr. Fai is the citizen of Pakistan. More often than not, in any case involving citizens from Canada and USA who face some sort of threat abroad, the Government of Canada or USA utilize the authority of their foreign offices in the recipient country to help the individual evade the problem.
Accordingly, Ms. Hina Rabbani Khar the foreign Minister of Pakistan is therefore solicited to kindly intercede in the matter of Dr. Fai to free him from this erroneous accusation. Meanwhile, a Pakistani Passport should be issued to Dr. Syed Ghulam Nabi Fai to pave a way to appoint him as negotiator for the purposes of resolving the IDA: JK by reinstating the UN resolution of 1948 regarding plebiscite.

Separatists, civil society pitch for justice to Fai
SRINAGAR, Dec 31, 2011: Rising openly in support of Dr Ghulam Nabi Fai, the civil society representatives in Kashmir and the separatists today unanimously passed a resolution seeking justice to the US based executive director of the Kashmir-American Centre.
The resolution was passed at the seminar, 'Democratic front of the freedom movement and Dr Ghulam Nabi Fai', organized here by the Jammu and Kashmir Liberation Front (JKLF)with participation from advocates, academicians, doctors, columnists, journalists, political leaders and the members of the civil society. The seminar was also to pay tributes to the slain Prof Abdul Ahad Wani .
"…the assembly while taking cognizance of, and noting appreciation of his diplomatic efforts, urges Government of United States, the International community and freedom lovers around the world to recognize the role of Dr G N Fai as a moderating influence in seeking a solution to the unique problem of State of Jammu and Kashmir. His unconditional and unreserved efforts as the son of the soil in bringing together all stake holders, persons of different shades of-opinion Governmental and Non-Governmental representatives together on the negotiating table to evolve a peaceful solution through process of dialogue, constitutes an important basis in judging Ghulam Nabi Fai's involvement in the cause of freedom for his people," read the resolution passed in the seminar. "Defective analysis of the consequences," it read, "of the choice he made needs to be avoided to prevent miscarriage of justice….Expressing their full confidence in the judicial system of U S A, the assembly believes and trusts, that justice will not only be done, but seen to be done to Dr Ghulam Nabi Fai in the days to come and on the awaited occasion."
It was the second resolution passed within a fortnight in favour of Dr Fai.
Earlier on December 24, a resolution was passed by the assembly of civil society members, intellectuals, writers and political leaders at the seminar organized by the Hurriyat conference (G). In the resolution, the participants announced their complete support to Dr Fai.
The chairman JKLF, Mohammad Yasin Malik, however, said the prosecution of Dr Fai would lose America the "constituency" in Kashmir, and that leniency in the case was must for resolution of the Kashmir issue.
"By keeping him (Dr Fai) in jail, is not America losing its constituency in Kashmir? Is it not it creating anti-America sentiment in Kashmir?" Malik asked in his address at the seminar.
"..If Kashmir issue is to be resolved peacefully, the US must show leniency in Dr Fai's case," he said.
Malik urged that both India and America should acknowledge the role played by Dr Fai whom he described as the "peace maker."
"I am not trying to point fingers at the judicial system of that country (US)," he said, "Perhaps there are certain unique norms in the US law and that may be why Dr Fai was arrested. But having said that, I want to clear it to both India and the US that he (Dr Fai) is a 'peace maker' who wants a political and peaceful resolution of the Kashmir issue."
The JKLF chairman cited instances where the lobbyist was involved by New Delhi in the peace process.
"I suggested Dr Fai's name to the Indian government for bringing militants to the table. The suggestion was acknowledged by the then Indian prime minister who actually sent one of his cabinet ministers to meet Dr Fai in America," he said and urged the society to rise in support of Dr Fai.
"…It was him who took Kashmir issues into the US parliament and the senate, and discussed it in Universities across that country. He took Kashmir issue to every US think tank. Today when he is in jail we shall think how to help him to get out of this trouble," he urged.
Malik also paid rich tributes to Prof Abdul Ahad Wani on his 18thdeath anniversary.
'Dr Fai was made scapegoat'.
The Hurriyat (M) senior leader and Chairman National Front, Nayeem Ahmad Khan, however, termed Dr Fai's arrest a result of US-ISI tussle. Dr Fai, he said, was made a scapegoat in tussle between the Pakistan intelligence agency and US.
"The main thing is that the Dr Fai was made a scapegoat in the tussle between ISI and the US. It was the situation changed in 2000 that the US started creating problems for Dr Fai. Otherwise the technical issues were there in the past also, but Dr Fai was never arrested," Khan pointed out.
Seconding the JKLF chairman, he said the US would lose its "constituency in Kashmir" and across the world if it continues to persecute Dr Fai.
"We should pass a resolution and send it to USA that Fai was a man of peace," Khan said.
Advocate Zafar Shah praises Dr Fai Those pleading the case of Dr Fai included advocates also.
The noted lawyer, Advocate Zafar Shah, praised Dr Fai for confessing to his charges.
"To me the greatest moment was when he confessed to the charges leveled in him. I see Dr Fai as the son of the soil with the difference because here we have people yet to confess what they do. We are hypocrites, but Dr Fai as well as Prof Abdul Ahad Wani has been person of great integrity," Shah said.
Dr Sheikh Showkat questions justification to prosecute Dr Sheikh Showkat, professor of law the University of Kashmir, questioned the America's justification for prosecuting Dr Fai for she has never abided by the law. "Has the US always followed law? What law did US follow in Guantanamo?" he questioned.
"Dr Fai was a person who did not lose his integrity in US. He went to US and worked for his homeland," Dr Showkat added and urged the society to follow his example.
"We must be true to our conscience and the same must reflect in our actions. If we do not do that we will be disconnected and separated, and we will become fossils. From these two persons (Dr Fai and Prof Wani) we must learn not to beg." 'Society must stand by him'
The high court bar association president, Advocate Mian Abdul Qayoom, said the society must stand by Dr Fai. "We shall be thankful to those who speak in our favor. And, if Dr Fai has done anything we shall support him. We must acknowledge his support to the Kashmir cause irrespective of him being an agent or not." 'Contribution will go waste'.
Dr Sheikh Mohammad Iqbal, who was presiding over the function, said the contributions of Dr Fai, and people like him, would be nullified if the Kashmiri society continues to do what it has been doing.
"The contribution will be reduced to zero if we continue to do what we are doing," he said, citing the example: "We are selling our land and buying cars."
The others who spoke on the occasion included: Zahid Ghulam Muhammad, Dr Javid Iqbal and Riyaz Masroor.

Movement needs diplomatic front: Yasin Malik
Speakers Hail Dr Fai As Ambassador Of Kashmir

Srinagar, Dec 31, 2011: Hailing the contribution of Dr. Ghulam Nabi Fai and Prof. Abdul Ahad Wani in the ongoing struggle, Jammu and Kashmir Liberation Front Chairman Muhammad Yasin Malik Saturday said resistance movement needs a powerful diplomatic front for success.
Addressing a seminar titled "Diplomatic front of the movement and Dr Ghulam Nabi Fai" on the anniversary of the noted legal luminary Prof. Abdul Ahad Wani, Malik said resistance movement cannot achieve success without having a strong diplomatic front for lobbying of the cause.
Asking the United States to take lenient view in the case of Dr. Fai, Malik said, "I don't want to question or confront US judicial system but I would make an appeal to them to take lenient view in Fai's case as he was a peacemaker. It will be their biggest support to the moderate constituency which wants peaceful resolution of Kashmir, without bloodbath and hatred. We need to see Dr Fai on bigger canvass, he was representing peaceful constituency."
Terming Fai as an ambassador of Kashmir, Malik said he always stood for peaceful resolution of Kashmir. "Whenever Kashmiri leaders or intellectuals visited USA, he extended hospitality to them and arranged their meetings with US government officials. He took Kashmir issue into US Senate, Congress and universities," he said.
Asserting that action against Dr. Fai would create anti-US constituency in Kashmir, Malik said, "Fai is not a person but an institution who always spoke moderate language in United States and other parts of the world."
JKLF chairman also disclosed that he suggested the name of Dr Fai to India for bringing militants on board after initiation of peace process between India and Pakistan in 2004.
"During parleys with PM, I asked for the involvement of militants and PM gave serious thought to my suggestion. I asked PM to approach Dr. Fai to strengthen peace and dialogue," he said, adding that a then Central Cabinet minister also met Dr. Fai over the issue of engaging militant leadership.
Malik said during his meetings with US Assistant Secretary Christiana Roca and advisor of president on south Asia; he pitched for involvement of militant leadership in the peace process.
Praising the contribution of Prof. Abdul Ahad Wani who was killed on December 31, 1993, Malik said international figures were impressed by his intellectual capabilities.
"When United Nations Army General met Wani, he told him if there are 10-15 persons in the world like him there would be a revolution. The US assistant secretary of state Robin Raphel after a meeting with Wani said that she doesn't think US President is more intelligent than him. Shadow Foreign Minister of Labour Party during an interaction with him was taken by his intellect," he said.
Malik said Wani defended the struggle in early 90s and mobilized global opinion in favour of the struggle by his capabilities. "History will never forgive the killers of Wani nor they can be part of civilized society," he said.
Senior separatist leader and National Front Chairman Nayeem Ahmad Khan said Dr. Fai is representing the sentiments and aspirations of Kashmiris. "Entire Kashmir is at his back .America should know that representing the aspirations is not a crime under any law of the world," he said.
Paying tributes to Prof. Wani, Khan said best tribute to the martyrs of Kashmir is to take the ongoing movement to its logical conclusion."Conscious nations don't forget their martyrs," he said.
Senior Hurriyat (M) leader and Ittehad-ul-Muslimeen patron Moulana Abbas Ansari said Kashmiris shouldn't expect any favour from US or other Western powers as their policies are guided by their interests. "We should leave everything to Allah and these powers cannot be of any help to us anyway," Ansari said, adding that leadership shouldn't desist from calling spade a spade. "We should always speak truth," he added.
Former HCBA president Nazir Ahmad Ronga in his speech said that status quo will lead to slavery and "we should accept 1953 position as an interim arrangement." "We are in the search of peace and need way out for the resolution of Kashmir issue. Leadership shouldn't shy away from talking if India is making an offer," he said.
Noted columnist Z. G. Muhammad said Kashmir lacks proper documentation about the heroes who gave their life for motherland. "I have one grouse that none of us tried to document life of our martyrs and their contribution to the struggle," he said, adding that Kashmir is yet to produce any intellectual. "We cannot call a person intellectual who writes for getting award and in real sense the intellectual means who stands by right side," he said.
Senior High Court Lawyer Zaffar Ahmad Shah said both Dr. Fai and Prof. Wani were the men of integrity. "If we look at their personalities they stuck to their integrity despite suffering immensely," he said, adding that "advocate" writers are causing damage to the movement. "If they are getting paid for write-ups, they are misleading the people. They shouldn't write then," he said.
President of High Court Bar Association Main Abdul Qayoom said people need to introspect and choose between right and wrong. "We don't know with whom we are affiliated. During 2008 lakhs of people came on roads but voted in large numbers during assembly elections. Same happened in 2010," he said, adding that masses need to differentiate between benefactors and oppressors. Qayoom added that stable Pakistan was in the interest of Kashmiris and 'its weakness will tell upon our movement.'
Noted journalist Ghulam Nabi Khayal said two decades after the brutal killing of Mirwaiz Moulana Muhammad Farooq, his killers are yet to be arrested.
"After the killing, then director general of police J.N. Saxena told me that they have arrested two persons involved in the killing and third person is absconding. But two decades down the line killers are yet to be identified," he said.
Kashmir University Law department faculty member Dr. Shiekh Showkat Hussain said international community including US cannot be mobilized by petitions. "History stands testimony to the fact that US has always been vulgar culprit and abuser of international norms," he said, adding that its policy is determined by economic interests. "When India opens its markets, Kashmir ceases to be a nuclear flashpoint for US," he said.
Among others, Advocate Sareer Fazili spokesman Kashmir American Council (via telephone), Prof. Shiekh Muhammad Iqbal, Dr. Javaid Iqbal, Abdul Majid Zargar, Dr. Zaffar Mehdi, Prof. Rehman Rahi, Riyaz Masroor, Dr. Altaf Ahmad spoke on the occasion. The speech of JKLF supreme head Amanullah Khan was read by Showkat Ahmad Bakshi while proceedings of the seminar were conducted by Shiekh Abdur Rashid.
On the occasion, a resolution asking US to administer justice in the case of Dr. Fai was passed.
The resolutions says: "An assembly of Kashmiri political formations, jurists, intellectuals, public thinkers, doctors, historians, scholars and civil society was organized by Jammu Kashmir Liberation Front (JKLF) to deliberate upon Dr. Ghulam Nabi Fai's role on the diplomatic front of Kashmiri freedom struggle.
