Do you have approval of scholars of islam in Pakistan that Jihad with Pakistani government is legal per shariah. I think no one mufti or scholar has allowed this so far. Then its a Major Sin to kill those persons (whether they belong to security forces) who have not attacked you. PEW Clarification

It is to inform all the concerned that PEW standby its stance over expected LNG deal.

The matter has been published in the independent media and later contradicted

by the Petroleum Ministry, a statement issued here said.

It is to clarify that the estimates of loss expected to the public exchequer were

very conservative. The actual losses, if deal finalised, will be much higher.

It must be noted that a lot is going on in the petroleum ministry, involving top officials,

 which can be brought to the limelight immediately if PEW continued to receive threats.

PEW is not against any person or institution, we have pointed out what we thought was wrong.

It is to clarify that we will continue to highlight such issues. Ministries and departments are

advised in the national interest to put their own house in order.

Anyone, having any reservation over any news, is free to invoke the law.

The spot rate of LNG has yet not touched the mark of $13 mmbtu.

The Act which can make the President vulnerable.

There is an Urdu proverb which says, "Nadan Dost Se Dana Dushman Behtar Hai" It means 'a wise enemy is better than a stupid friend'. The proverb applies on the friends of Asif Ali Zardari. He has plenty of them. In recent weeks and months he has been discarding them one by one. The latest being the one (though he has not yet been discarded) who drafted the bill on the 'Contempt of Court'. The Bill was converted into The Contempt Act 2012 by passing it speedily through both the Parliaments. President AAZ took an early flight from Karachi to sign it before the midnight. With the same speed it was put on the cyberspace. Some even say that it was put on the cyberspace pages before it was signed by the President.

The pinhead lawyer friend who had drafted the Bill to save the prime minister and other corrupt executives from the contempt cases and demean the judges of the superior courts has potentially exposed the President from the immunity he has under Article 248 of the Constitution.

When Mr. Aitzaz Ahsan was asked in the Supreme Court by an honourable Judge whether he wanted to discuss the Article 248 (1) in the defence of the prime minister Yusaf Raza Gilani, he immediately replied in negative. Aitzaz understood that by bringing up the said Article in the contempt case, he would be opening a Pandora Box making the immunity of the President discussable and so questionable. The hurriedly passed Act 2012 can do what Aitzaz wanted to avoid.

He knew that parts of the Article 248 pertaining to the immunity of the President and Governor are in direct conflict with the;

  1. Preamble, which states;

  • "Whereas sovereignty over the entire Universe belongs to Almighty Allah alone"

  • "Wherein the Muslims shall be enabled to order their lives in the individual and collective spheres in accordance with the teachings and requirements of Islam as set out in the Holy Quran and Sunnah"

  • Wherein the independence of the judiciary shall be fully secured

  1. Article 8, which states;

(1) "Any law, or any custom or usage having the force of law, in so far as it is inconsistent with the rights conferred by this Chapter, shall, to the extent of such inconsistency, be void"

(2) "The State shall not make any law which takes away or abridges the rights so conferred and any law made in contravention of this clause shall, to the extent of such contravention, be void

  1. Article 31 (1), which states, "Steps shall be taken to enable the Muslims of Pakistan, individually and collectively, to order their lives in accordance with the fundamental principles and basic concepts of Islam and to provide facilities whereby they may be enabled to understand the meaning of life according to the Holy Quran and Sunnah"

  2. Article 204 (2 a), which states, "A Court shall have power to punish any person who abuses, interferes with or obstructs the process of the Court in any way or disobeys any order of the Court"

  3. Article 204 (3), which states, "The exercise of the power conferred on a Court by this Article may be regulated by law and, subject to law, by rules made by the Court"

So, by adding 'the Prime Minister, a Federal Minister, a Minister of State, the Chief Minister and a Provincial Minister to already existing provision provided in Article 248 to 'the President and a Governor' made the said Article weak and controversial, meaning by the Supreme Court can;

  1. Strike down the Article 248 in its entirety ordering that it is in conflict with the Preamble and other Articles.

  2. Send Article 248 back to the Parliament to rewrite it a fresh keeping the basic structure of Constitution and principles of Quran and Sunnah in mind.

  3. Suspend the newly framed Act 2012 till the legislation is made on the new Amended Article 248.

Such a decision would mean that the Article 248 which protects the President is no more part of the Constitution and the government would have no excuse not to write the letter to the Swiss Court. This reminds me of a story whereby a person was weary of his beard. He prayed to God asking Him to get rid of his hair. His prayers were answered and one day he woke up to find no hair on his body. He was disgusted to see his bald head and face with no beard, eyelashes and eyebrows. He started praying again asking God to give him hair. One morning he woke up finding hair all over his body including his forehead, nose, lips, palms and soles. Annoyed with his condition he started praying to have his original beard back. We don't know about the outcome of this Act which is already challenged in the superior court, but one thing is for sure that the deviser of the draft will be cursing himself fearing that the President might loose his immunity in the process.

Talking on a TV chat show, the shrewd and rather happy-looking Babar Awan pointed his finger at the incumbent law minister to be the architect of the draft. He also said that the law minister rejected the original draft prepared by the Attorney General and replaced it with his version which he tabled on the floor of the Parliament. Babar Awan further disclosed that the law minister wants to hold an added portfolio of Attorney General.

This incidence takes me back to March 2007 when General Musharaf approved a draft which cost him the presidency in the end. Some believe that it was a trap prepared by the agencies through his friends and Musharaf fell into it. AAZ's closet is full of such friends. One such close friend, the law minister, has drafted the Act 2012 which can hurt AAZ badly. The question is did he do it as a 'Nadan Dost' or he had something else in mind which was not just to have an additional portfolio as pointed out by Babar Awan? Whatever the reason Asif Ali Zardari should start looking for black goats in the market. He would need plenty of them very soon.

New UNODC awareness campaign highlights transnational organized crime as an US$ 870 billion a year business

EMBARGO: 16 JULY 2012 – 1am CET (VIENNA)

Vienna. 16 July 2012. UNODC today launched a new global awareness-raising campaign emphasizing the size and cost of transnational organized crime. Profiling this multibillion dollar a year threat to peace, human security and prosperity, the campaign illustrates the key financial and social costs of this international problem through a new public service announcement video and dedicated fact sheets for journalists.

With a turnover estimated to be around US$ 870 billion a year, organized criminal networks profit from the sale of illegal goods wherever there is a demand. These immense illicit funds are worth more than 6 times the amount of official development assistance, and are comparable to 1.5 per cent of global GDP, or 7 per cent of the world’s exports of merchandise.

Available at www.unodc.org/toc, the campaign is being rolled-out through online channels and international broadcasters and aims to raise awareness of the economic costs and human impact of this threat. By dealing with issues such as human trafficking, the smuggling of migrants, counterfeiting, illicit drugs, environmental crime and illegal arms, it offer an insight into today’s core criminal areas.

With an estimated value of US$ 320 billion a year, drug trafficking is the most lucrative form of business for criminals. Human trafficking brings in about US$ 32 billion annually, while some estimates place the global value of smuggling of migrants at US$ 7 billion per year. The environment is also exploited: trafficking in timber generates revenues of US$ 3.5 billion a year in South-East Asia alone, while elephant ivory, rhino horn and tiger parts from Africa and Asia produces US$ 75 million annually in criminal turnover. At US$ 250 billion a year, counterfeiting is also a very high earner for organized crime groups.

Besides these monetary figures, the human cost associated with transnational organized crime is also a major concern, with countless lives being lost each year. Drug-related health problems and violence, firearm deaths, and the unscrupulous methods and motives of human traffickers and migrant smugglers are all part of this. Millions of victims are affected each year as a result of the activities of organized crime groups with human trafficking victims alone numbering 2.4 million at any one time.

The UNODC-led campaign also illustrates that despite being a global threat, the effects of transnational organized crime are felt locally. Crime groups can destabilize countries and entire regions, undermining development assistance in those areas and increasing domestic corruption, extortion, racketeering and violence.

“Transnational organized crime reaches into every region, and every country across the world. Stopping this transnational threat represents one of the international community’s greatest global challenges”, said UNODC Executive Director, Yury Fedotov. “Crucial to our success is our ability to raise public awareness and generate understanding among key decision and policy makers. I hope that the media will use UNODC’s campaign to highlight exactly how criminals undermine societies and cause suffering and pain to individuals and communities,” he added.

The campaign drives the message that someone ultimately suffers and there is always a victim. Money for instance is laundered through banking systems, undermining legitimate international commerce. People become victims of identity theft with 1.5 million people each year being caught out. Criminal groups traffic women for sexual exploitation and children for purposes of forced begging, burglary and pick pocketing. Fraudulent medicines and food products enter the licit market and not only defraud the public but can put their lives and health at risk.


The multi-language campaign consists of a 30- and 60-second Public Service Announcement, a set of posters, a series of fact sheets and various online banners. All materials are available through the campaign website – www.unodc.org/toc.

both hands .Mr. Amin Fahim who already involve in many corrupting cases and
some cases has already proved against him another financial scam on the
card against him .Mr. Fahim appointed Mr. Shahid Bashir as Pakistan envoy
to WTO at Geneva in 2009 for two year, later his service extended for
further 2 years, while allegedly receiving millions as bribe. after
serving about 4 year with no performance, Mr. Shahid Bashir now retiring
from services next month in August but despite of his due retirement ,
he is again active in Islamabad to extend his service in WTO for second
time and in this connection the minister for commerce and trade Amin Fahim
has again send a summary to the Prime minister to further extends his
service as envoy to WTO in Geneva and he again offered a big financial and
employment deal to the Minister for commerce and trade. Although there is
clear orders of the Supreme Court that retired government servant should
not be again appointed. Mr. Shahid Bashir who served in the commerce
ministry as joint secretary is the most corrupt and incompetent person and
the ministry already has raised serious reservations on his performance and
appointment in WTO but the Minister strongly back him as will again receive
a huge money as bribe from Mr. Shahid Bashir . The ministry of commerce
and the Supreme Court should take strong action against a corrupt person
like Shahid basher how and why he paying huge money for abroad appointment
and how a retired person can be appointed as envoy.

Hurriyat's economic advisory council

Hurriyat (M) is going through a rough patch and is faced with many challenges. The principal challenge is the demand to restructure the forum. Hurriyat (M) chairman, Mirwaiz Umar Farooq on Tuesday 10 July after chairing a meeting of the Executive and the General Council, ruled out any restructuring of the amalgam. It is not clear whether the motion was put to a democratic vote or not. Encouraging evolution and updating a political structure is highly desirable and a step forward.

 

Addressing a news conference Mirwaiz said "We cannot be mute spectators to economic exploitation of our natural resources and we have decided to constitute Economic Advisory Committee to formulate a strategy for protecting our resources. We will involve civil society members, traders and businessmen to have broad strategy over economic issues. Hurriyat cannot keep itself aloof from day-to-day problems of people."

 

There could be no two opinions that the natural resources in particular water embedded in the natural habitat of Jammu and Kashmir are trust properties in the respective areas of the State administered by India and Pakistan. India and Pakistan as such cannot violate their trust obligations and override the primary interest of the people of Kashmir. Our leaders have never sought to defend the natural resources and the merits of the interest shown by Hurriyat for the first time in the last 22 years need to be examined.

 

The exploitation of the natural resources of Kashmir was first raised by India. Government of India on 21 August 1957 raised the first objection against the decision of the Government of Pakistan to build Mangla Dam Project in Mirpur (AJK). Indian Government accused Pakistan of "consolidating its authority over the Indian territory of Jammu and Kashmir and of the exploitation of the territory to the disadvantage of the people of the State and for the benefit of the people of Pakistan". The letter added that "Pakistan's action was in violation of the Council's resolution of 17 January 1948 and of the assurances given to India by the chairman of UNCIP".

 

Over the last 22 years Hurriyat should have graduated into making mature judgements and should have emerged as a reliable political discipline. It seems that it has not benefited from the good will of Governments of India and Pakistan, good will of various schools of opinion and the good will of the common man and woman in Kashmir.

 

The decision of Hurriyat (M) to take on board new issues like setting up of an Economic Advisory Committee is at variance to its own Constitution. It is a non-starter.  Article 2 in chapter II of the Hurriyat Constitution does not provide for taking any such decision of constituting an Economic Advisory Committee to formulate a strategy to protect Kashmiri resources as announced in the news conference.  The procedure to amend the Hurriyat Constitution is set out in Chapter IV and it requires a "majority of not less than two-third of the total membership". A proper Resolution has to be moved in the General Council and as a general rule proper notice of any such Resolution has to be given to all members entitled to vote. Amendments are not carried out in ordinary meetings.

 

Even if Hurriyat (M) succeeds to set up an Economic Advisory Committee, it would not have any power to enforce its strategy against India and Pakistan. The only workable route left out to Hurriyat (M) to keep the dignity of its decision, is to seek guidance from article 13, 14 and 15 of the Constitution of Jammu and Kashmir. Under article 13 the State is bound to establish a socialist order for the promotion of welfare of the people. Under article 14 the State has to develop the economy in a planned manner. Under article 15 the State has to ensure speedy improvement in the standard of living of rural masses.

 

Elected Government of the State at Srinagar and the other two Governments at Muzaffarabad and Gilgit are under oath to serve the people. The oath is enforceable through debates in the respective assemblies and through the courts. The elected representatives in the J & K Government have taken an oath to "do right to all manner of people in accordance with the Constitution and the law, without fear or favour, affection or ill-will".

 

The decision of Hurriyat (M) taken on 10 July 2012 has its answers not in Hurriyat Constitution adopted on 31 July 1993 but in the Constitution of Jammu and Kashmir adopted on 17 November 1956. A concurrent interest in the process and quality of life of the people, in the economy, health, employment and in the preservation of natural resources should have been a concurrent interest of Hurriyat from early 1990. It decided to reserve for itself an exclusive political agenda set out in the Constitution adopted on 31 July 1993 and decided to execute its agenda among other means, through a culture of regular and arduous shutter down calls.

 

Hurriyat failed to realise that the trader and the consumer were local Kashmiris. The shutter down calls hurt the common man and the economy of the State. A reversal being contemplated in July 2012 would not carry the economy or the political agenda of the alliance any further. It is a non-starter from the beginning. The announcement is yet to be made part of Hurriyat Constitution and at the same time it does not reconcile the demand of a restructuring in the forum.

 

No one would wish Hurriyat to fail its people and people would not be ready for a long time to trust any new political set up. It would be unfortunate if after witnessing the death of a generation and with it killing the right of self-determination for a long time to come, putting people through unprecedented suffering and humiliation never seen from 1846-1990, Hurriyat fails to settle genuine grievances of its various constituents and wishes to keep the status quo through the use of numerical upper hand. It would be a serious error of judgement if number game is relied upon to disadvantage senior and active leaders like Shabir Ahmad Shah, Nayeem Khan and some others.

 

It is a fact that some of the constituents are solo passengers in a fixed wing aircraft. The substantive merits of all constituents could not be regarded as the same and Shabir Ahmad Shah is one who could not be brushed aside for any reason. A resolution of all internal irritations should not be a matter of concern for the public. Every sincere effort is needed to find a solution to the present internal discord and to transform Hurriyat into a reliable political platform.

 

Unfortunately, Hurriyat has started showing up the lepers spots. It does not subscribe to the universality of the Kashmir case and only looks for a berth for itself in India Pakistan dialogue. In fact it has committed itself to accepting Kashmir as a bilateral dispute between India and Pakistan and even has distanced itself from the title to self-determination. It is seeking a negotiated settlement and would not hesitate to recycle the same numbers in any dialogue with India and Pakistan or in anything that happens around the issue of Kashmir.

 

Hurriyat in its present shape and on the strengths of its left over constituents is doomed to fail. The diplomatic, political and moral support of Pakistan has passed its sell by date and we are seen as a reflex of a non-Kashmiri interest.

Literacy, financial, medical assistance to needy can alleviate poverty, believes Hina Fysal

Quality education can bring change in the country

Begum Mehmooda Welfare Trust (BMWT) has constructed 20-bed hospital for the people of Desra village of district harripur. The trust would ensure free of cost treatment, provision of medicines and Out Patient Department (OPD) services to the ailing patients of the poor and needy families.

As the area of Desra valley of Harripur district lacks quality healthcare services from the last many years which caused loss of many precious lives. Taking an initiative, BMWT constructed modest hospital having the latest machines and equipments for the patients treatment. The basic test examining labs will be inside the hospital so that all the patients can get the required treatment.

This initiative will help people of Desra valley and villages in 20 kilometres distance from the valley to save precious lives, cost of travelling and get better healthcare facilities at the doorstep. The trust is set to start operations of the hospital in October this year.

Hina Fysal, Chief Executive & Co-Founder of Begum Mehmooda Welfare Trust said, it aimed poverty alleviation through literacy, financial and medical assistance to the un-served communities living below the poverty line from decades".

At present, the trust is working on five major programs health improvement and medical, education, food, wedding composition and income support program in Harripur, Sangra, Desra valley of KPK and in some urban parts of Islamabad. To-date, the trust has changed the lives of more than 500 families in these areas, she mentioned".

Under health improvement and medical program, the trust is working with government hospitals of twin cities to provide best medical facilities to the needy patients. It ensures provision of medicines and other health facilities from these hospitals. BMWT provides medicines and other remedial necessities to those people who cannot afford themselves.

Under the education support program, BMWT ensures provision of quality education to the needy students of suburbs of Islamabad; the trust provides school uniforms, bags, stationery and bears all the educational fees of 100 students. The parents of these students were unable to afford schooling due to economic burden on their shoulders.

BMWT food support program delivers fodder including ghee and wheat to the needy communities every month where it is extremely unreachable in terms of both availability and prices.

Another big achievement of family trust is provision of dowry for the marriages of poor females belonging to the poor communities under wedding composition program. Since its establishment in 2008, the trust provided dowry and organized more than 75 weddings.

Along with eliminating poverty from the gross roots level, the trust is helping the widows of old ages living with their son's or grandson's but not generating revenues for their own livelihood. Under the income support program, the trust helps these poor widows by providing cash assistance, so that these widows can purchase medicines or fulfil their necessities of life.

TORONTO - An official with the Consulate General of Pakistan in Toronto has been recalled following an inquiry into a sexual assault allegation.
 
The married father of two allegedly assaulted a female passport applicant inside the North York consulate in February.
 
Toronto Police were not called to investigate the matter. Consular officials conducted their own investigation which wrapped up late last month.
 
After collecting statements from both sides, the investigative committee declared the man was "totally unfit" for government service.
 
The committee "held the accused guilty of trying to use his position to coax the victim into a locked room with malicious intentions of molesting/physically assaulting her," said a consular report obtained by the Toronto Sun.
 
The June 23 report shows that the allegation was reported on Feb. 12 by a "respected community member." The consular official allegedly took the victim "into an isolated locked room."
 
The victim is identified as a Pakistani-Canadian woman from Thorncliffe. The report states that the employee was in charge of MRP (machine-readable passport) processing.
 
The only people aware of the allegation were the accused, the victim, and committee members.
 
"Inquiry officers were told to type notes themselves to keep the inquiry confined within the four walls of the office," reads the report, signed by acting consul general Imran Ali.
 
The document also states that the woman "did not go to Toronto law enforcement authorities on our assurances that we would hold an impartial inquiry and the culprit would be brought to justice."
 
Sources confirmed no attempt was made to stop the woman from going to Toronto Police when the allegation first came to light.
 
The report also states that the RCMP was informed about the inquiry "to pre-empt embarrassment" if the victim later contacted the authorities. It later acknowledged the possible "negative consequences" if the victim contacted Canadian law enforcement or media.
 
When asked about the incident, acting consul general Imran Ali issued a statement this week, saying, "We endeavour to run a consulate which works for the welfare of the Pakistani-Canadian community and have personnel rules reinforcing the above principle."
 
The report also detailed parts of the man's defence, noting he accused the woman of "being a liberal and a model" — accusations that the inquiry found "obnoxious and filthy."
 
He also allegedly "tried to malign" two junior colleagues during his defence.
 
Dismissed on June 25, the man is no longer inside the consulate. His visa expires in July.
 
The report added, "He must be proceeded against by his department for removal of service on grounds of moral turpitude" once in Pakistan. Attempts to reach the man and the complainant were unsuccessful.
