Those ill-informed parliamentarians and lawyers who come on the talk-shows and boastfully declare that the Parliament is superior to the Judiciary should read the recent decision of the American Supreme Court on the healthcare issue, which stated that 'the powers of legislature are limited; our deference in matters of policy cannot, however, become abdication in matters of law, and there can be no question that it is the responsibility of this court to enforce the limits on federal power by striking down acts of Congress that transgress those limits.' The American Supreme Court quoted the 1803 judgement in Marbury v. Madison, which stated the powers of the legislature are defined and limited; and that those limits may not be mistaken, or forgotten.
After the American Supreme Court decision those wizards who are known to give example of the American democratic system should give a permanent rest to the rhetoric of calling the Parliament superior to the Judiciary. The fact is that the Constitution of Pakistan is superior not the Parliament or the Judiciary.
